The following docket report and court documents pertain to the first of two appeals that Luke Wenke filed in reference to his first cyberstalking case and subsequent probation violation charges. Wenke was found guilty of indirectly contacting his cyberstalking victim via an email to the victim’s business partner just weeks after his release from federal prison. He had been ordered to have no contact whatsoever with the victim, including by indirect/third party means.

Wenke maintained his innocence, but the judge nevertheless determined that he was responsible for the email and that he sent it with the intention of it reaching his cyberstalking victim. The prosecution urged the judge to send him back to prison for a year, but he was sentenced to time served and ordered to undergo additional outpatient mental health treatment, which he complained incessantly about on social media even though he had been spared from an additional 12 months behind bars.
